Well, it turns out that Nightdive Studios has put the System Shock remake on hiatus. The plan was to make a faithful recreation of System Shock; instead they got caught up in feature creep and expanding the game - neither of which the backers really wanted - in hopes of luring securing additional investor funds, which failed. Now they're mostly out of money and hope to have the game done in 18 to 24 months. I'm not so optimistic; it looks probable that I'm going to end up with my first KS cautionary tale to share.

Shame. According to that statement, it seems like they used the backers as investors that they have no responsibility towards.

I could be wrong, but don't business investors have contracts that obligate a company to them for compensation?

If true, then Kickstarter is nothing but a den of potential thieves who have no obligation to fulfill since Kickstarter washes it's hands of involvement.

That sucks. And it re-affirms my stance of never backing video game projects. Their failure rate is just too high.

I was short for time so left a brief answer. If you're talking a bank loan, then yes, there's a debt and the bank has firsties on payojts during a bankruptcy action. But venture capitalists, i.e., speculators, get a percent share of the company and hope for it to hit. They'll spread their costs across dozens of ventures, all will die save one leaving them holding the bag. But the one that succeeds may pay back 10,000 to 1 or more, so jt works as a business model.

Kickstarter is much more in the venture model. In fact its original intent was to be a donation service where you got nothing in return save for fulfilling the inventor's dreams. It's changed, but that "make our dream a reality" verbiage lingers on. In theory you can go after them for an implied contract in court, but that's a lot of work to get your $49 back. It's a lot of work even for a class action suit . Anybody doing this for big money is going to have an LLC set up, and when the LLC has no money there's no money.

You take your chances.
